{"id":2912,"date":"2024-02-21T12:53:49","date_gmt":"2024-02-21T11:53:49","guid":{"rendered":"https:\/\/ecom-data.douglas.de\/?page_id=2912"},"modified":"2026-07-24T11:07:52","modified_gmt":"2026-07-24T09:07:52","slug":"legal-requirements","status":"publish","type":"page","link":"https:\/\/ecom-data.douglas.de\/index.php\/legal-requirements\/","title":{"rendered":"Legal Requirements"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9bdcd2\" class=\"has-inline-color\">Effective August 2, 2026:<\/mark><\/strong> <strong>EU AI Act \u2013 EU Icons for Labelling AI-Generated Content<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The European Commission has published the <strong>&#8222;EU Icons for Labelling AI-Generated Content<\/strong>&#8220; initiative under the <strong>EU AI Act<\/strong>, introducing transparency requirements for certain AI-generated and AI-manipulated content.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The following content is affected:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Product images<\/strong> uploaded via PRIMA<\/li>\n\n\n\n<li><strong>Product videos<\/strong> for use on Product Detail Pages (PDPs)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When is labelling required?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please use the AI icon if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>product images or videos were fully created using generative AI,<\/li>\n\n\n\n<li>real content has been substantially altered using AI, or<\/li>\n\n\n\n<li>depicted people, objects or scenes do not actually exist or were not genuinely recorded.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When is labelling not required?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Labelling is not required when AI is only used as a supporting tool, for example for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>background removal<\/li>\n\n\n\n<li>retouching<\/li>\n\n\n\n<li>background adjustments<\/li>\n\n\n\n<li>colour or quality enhancements<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">and the authenticity of the product remains unchanged.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What action is required?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For all applicable media assets, the AI icon must be integrated into the respective image or video. The technical specifications and SVG icon can be found here:&nbsp;<a href=\"https:\/\/dam.douglas.eu\/guidelines\/guide\/759e76ed-7f99-40f1-8688-c874b4815d62\/page\/03208308-99c0-4a79-9264-6744f58c5af7\" target=\"_blank\" rel=\"noreferrer noopener\">07_SUPPLIER GUIDELINES<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When does this requirement apply?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no requirement to label content retroactively.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Only product images and product videos published or provided to Douglas <strong>on or after August 2nd, 2026<\/strong> must carry the AI label where applicable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Text requirements<\/strong> (delivered via BYRD\/bManaged)<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>INCIs<\/strong> for INCI relevant products (please find here a list of INCI relevant product types + a formatting orientation)<\/li>\n\n\n\n<li><strong>Manufacturer specifications <\/strong>for foodstuff and supplements (please see here an example how we need the information)<\/li>\n\n\n\n<li>Marking of <strong>potential allergens <\/strong>for foodstuff and supplements (please see here an example how allergens can get marked)<\/li>\n\n\n\n<li><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9bdcd2\" class=\"has-inline-color\">Effective September 27, 2026:<\/mark><\/strong> <strong>EU Directive 2024\/825<\/strong> <strong>(EmpCo)<\/strong>: To ensure that consumers receive reliable and transparent environmental information, generic environmental claims that cannot be substantiated with evidence are prohibited and will not be approved. <\/strong>such as colds, herpes, neurodermatitis is permitted<\/li>\n\n\n\n<li>The indications of the medicinal products <strong>must match the subject of the advertising\u000b<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>Mandatory information of medicinal products &amp; medical devices<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>name of the medicinal product <\/strong>(cf. Section 4 para. 1 no. 2 HWG)<\/li>\n\n\n\n<li>The <strong>indications for use<\/strong> (cf. \u00a7 4 para. 1 no. 4 HWG)<\/li>\n\n\n\n<li>The <strong>warnings, insofar as<\/strong> they are prescribed for the labeling of the containers and outer packaging (cf. \u00a7 4 para. 1 no. 7 HWG)<\/li>\n\n\n\n<li>When advertising to laypersons (i.e. always in our case!), the following text must also be <strong>clearly legible<\/strong> (see Section 4 (3) HWG): &#8222;For risks and side effects, read the package leaflet and ask your doctor or pharmacist.\u201d\u000b<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Compliance with EU Regulation on General Product Safety (GPSR)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">the European Commission has recently introduced new obligations under <strong>the General Product Safety Regulation (EU) 2023\/988 (GPSR)<\/strong>, which mandates that specific information must be provided for all products sold online, including the obligation to display product recalls on our website. This regulation applies from <strong>13th December 2024<\/strong>. To ensure compliance with the GPSR, it is crucial that all products distributed through our online platform meet the following requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Required Information<\/strong><br>In accordance with the GPSR, the following information must be made available for each product:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Manufacturer Information:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Name, registered trade name or registered trade mark of the manufacturer<\/li>\n\n\n\n<li>Postal address<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Responsible Person Information (if the manufacturer is not established in the European Union):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Name of the responsible person<\/li>\n\n\n\n<li>Postal address<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Product Identification Information:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Information allowing the identification of the product\n<ul class=\"wp-block-list\">\n<li>A clear picture of the product<\/li>\n\n\n\n<li>Type of the product<\/li>\n\n\n\n<li>Any other relevant product identifier (e.g. model of the product, list of ingredients for cosmetic products, textile composition of textile products)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Safety Information:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any warnings or safety information applicable to the product<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Action Required:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please ensure that the above mentioned <strong><u>information is ready to be submitted from now on<\/u> <\/strong>for the products you supply to us.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How to Submit the Information:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please maintain or upload the above mentioned information directly to our supplier portal at <a href=\"https:\/\/eur04.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fdouglas.byrd.io%2Flogin&amp;data=05%7C02%7Cc.pell%40douglas.de%7C8fa68109980f437372f908dcf8111b41%7C661d108003534416a568f85f2d4f2ff5%7C1%7C0%7C638657999603373501%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C0%7C%7C%7C&amp;sdata=FClyEvhBfP%2F%2BEnC%2FrGSCqFI31rcLsAdFfxe4SaLRhgU%3D&amp;reserved=0\" target=\"_blank\" rel=\"noreferrer noopener\">BYRD<\/a>. You must use the template for recall notices established by the Implementing Regulation (EU) 2024\/1435 of the European Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This information will be displayed on our website to ensure consumer safety and compliance with the GPSR.
